Residential Tenancies Act, 2006, S.O. 2006, c. 17

Contents of notice

(3) The written notice under subsection (1) or (2) shall specify the reason for entry, the day of entry and a time of entry between the hours of 8 a.m. and 8 p.m.  2006, c. 17, s. 27 (3).

A notice of entry was issued to all tenants at 111 Lawton Blvd. June 4, 2018, pertaining to an Akelius contractor entering their apartments on Wednesday, June 6th, 2018 between the hours of 10 a.m. to 2 p.m. The notice goes on to say that the entry will be at random - all suites will not be entered.

It is against the law to issue a notice to a tenant without giving a specific time between the hours of 8 a.m. and 8 p.m. as required under subsection 17(3) of the Act. It is also against the law for Akelius Canada to hold all tenants hostage while they decide which apartments their contractor will enter. It is further disgraceful of Akelius Canada Ltd to treat tenants in this manner as it has been reported Akelius Canada Ltd were informed by their contractor he/she would only need to see one apartment of each (one bedroom a two bedroom and a bachelor) 20 minutes at most to view.

Landlord and Tenant Board case rulings- Further note to Akelius Canada management, if you require entry into all apartment units at any given time it is your responsibility to work with your contractor or any other outside contractors to draw up a schedule to determine the length of reasonable time it would take to enter a floor of twelve apartments (example one-two hours and serve staggered notices of entry for groups of apartments setting out time of entry by specific apartment numbers.

Concerning building permits for apartments 308, 606 and 610 where are they and why have they not been posted?

Building Permits - requirement to post in a prominent location

City of Toronto - When you come in to pick up your building permit, you will be given a letter that spells out the requirement to post the permit in a prominent area on your property. This requirement is also printed on the front of the permit card itself (directly above the permit number). 

This requirement is under the Ontario Building Code, Division C, Part 1, Code Reference 1.3.2.1(1) and states: 

"Where a permit has been issued pursuant to the Act, the person to whom it is issued shall have the permit or a copy of it posted at all times during construction or demolition in a conspicuous place on the property in respect of which the permit was issued."

Akelius Canada Ltd. management, start treating the tenants with respect and start obeying the laws of Ontario and Toronto.

UPDATE July 31, 2018  9:15AM - Contractor had been here earlier and fixed the problem within 10 minutes. He said he knew what the problem was before the notices sent. Once again tenants are in their apartments waiting for the contractor to show between 9-5 today. Some people have taken the day off work to be here. Reason why some tenants stay home is it is well known that Akelius hands out the master keys to any contractor to enter apartments alone with out some sort of security standing by. Also witnessed a plumber going into an apartment with the master keys at 9:30 AM.  Reason to have a superintendent.
